Honda law suit over turned

The courts have overturned the woman's law suit over lower than advertized mpg. The courts determined that it was her driving style not the software update that is the reason for her poor mileage. The reasoning used for the decision was that most other drivers are getting much better than her and the majority are getting the advertized mpg numbers. She has to pay Honda's court cost and she will receive no monitory award.

 

Great day for Honda. I'm positive any decent hybrid driver could take her very car and better the advertized mpg numbers with it.

Had the software update and it went right back up to the mid 40's. Don't tell me it wasn't a software

problem. When it was bad, all the hypermileing in the world wouldn't get the mpg's past 38!!

The woman in the suit said the opposite, she claimed the update lowered her mpg. I have a friend that had the update and his numbers as did yours went up. He never got out of the 40's but with update he is now getting a few mpg better. This is why the suit was overturned because the majority of the drivers got much better than this person. She also admitted to not trying to conserve and that the sales person that sold her the car told her she would get 50 mpg in the car and that he did not tell her she had to change the way she drove. The person I know never had a problem staying in the 40's and even getting 50's on some tanks before and after the update.

The suit was over turned after her victory because as you said driving style can drastically affect the mpg in a hybrid and this is why Honda won the appeal due to the fact it was not the fault of the car but her driving style. The plaintiff lost, the appeal went to Honda.

Just Ordered my first Hybrid today! the 2013 Ford Fusion Hybrid. 47/47, I bought a Focus Titanium last year this time. My driving is very aggressive and I'm currently getting 23-26 at fill up. Not very good. So That's why i'm switching over, hopefully will help a bit.

Bob, you may want to rethink your order. Hybrids do increase mileage, but if you're an admitted aggressive driver, you won't see anything near 47/47. I'd bet you'll see mid-high 30's MPG with the hybrid if you don't change your driving habits. That's still an improvement over your Focus, but not high 40's

 

That said, the hybrid "SmartGauge/Eco-guide" will help coach you into better driving habits, but that will require a willingness to change on your part.

 

Have you ever driven a car with a CVT? They perform much different than you're used to. May want to try one before getting the hybrid.

Mid 30's? I doubt he will even see that. Drive it aggressive, with the CVT and you will see mid 20's. Patiently waiting for all the complaints that my Fusion isn't getting 47 MPG. You just know its going to happen. I know that I wont be seeing 47 anytime soon, not until spring and summer, and after the car has a few thousand miles on it. Right now quite happy with the 34 it's getting. Still on the first tank of gas, and very little city driving.
