My Poor Flex, bashed up but we are OK

That would have prevented the pile up for certain. I do believe the biggest contributor of this crash was the fact neither car had any lights flashing.

 

Now I wait, should hear if they are going to fix or total by this time tomorrow, in the mean time, I am trying to decide on our next steps in case it does become a total loss. Since I was upside down on the first Fusion and was able to work it out, I had no choice but to have a large monthly payment, but now I have an opportunity to make some financial changes and work on paying down a few other bills. So now need to locate something we can use over the next 2 years that is less than half what I pay now, then I can take the other half and split it between the CC I own on. I can have it all paid off in 2 years, and have enough saved for a decent down payment on a new or slightly used car that catches my fancy.

 

I would love to just replace the Flex with an identical one, but I dont want another 6 years of high payments on it, so maybe a nice used Diesel Excursion is in order. I may consider a 4 year loan on a used MKT, maybe a 2012 which has what the Flex had instead, but have to wait until I find out what insurance will do. If they decide to repair it, I have a body shop lined up that does excellent work and I trust fully to do it right.

Who was cited in the accident?

Very perceptive Hermans, I just received the incident reports and it appears the driver of the red car received one. This means all fault will be placed on him, from what I can see of the reports. The car I hit is not mentioned on my report, and the car that hit me was reported on a different report. The car (F250) on my report didn't touch me. I just finished uploading them to the insurance company.

 

Just wondering on this now, if a person gets cited for this, does that mean all fault is then placed on him, so the others involved dont get an insurance hike? Going to look up and see if I can find out what all these codes mean on the report. Something tells me he was on the wrong side of the road or was blocking the road.

 

OK found the code, 6-101 driving without a valid license.

Your comments make it sound like the incident reports are incorrect. I hope you're able to get them corrected if that's the case. My dad's car got hit a few yrs ago while he was parked on the street at work. The police officer who responded didn't realize that the two moving cars that collided had also hit his parked car and didn't include it in the report. When my dad contacted the officer who wrote the report the officer was very belligerent and said that he didn't care if his report was wrong. My dad even had witnesses (workmates) who saw his car get hit and the officer still wouldn't change his report. Since the report didn't include that my dad's car was hit, the insurance of the driver at fault wouldn't pay for the damage to his car. My parents had to file the claim against their insurance, pay their $500 deductible and watch their insurance rates go up, all because the police officer completed the report incorrectly and wouldn't change it. My dad even contacted his supervising officer who gave him the same answer, the Minneapolis Police Department doesn't care if the report is wrong. Once it's been written and filed they are done with it and won't touch it again. I hope you don't have a similar situation.

When i was in LE, and working traffic during my early years, there were times when it turned out my traffic report turned out to be wrong after discovering after the fact information. I always corrected the report and notified the respective insurance companies. From acdii's comments the driver of the car stopped in the roadway would be at fault.

 

Being cited for no OL is a cursory citation and does not, in itself, access fault. There must be another citation somewhere. If not. your insurance company will have to aggressively pursue the driver of the other car. The driver may not have insurance and worse the owner of the car may not have insurance. Then everybody's respective insurance company will have to bite the bullet.

 

Looks like a very tricky situation.

Thankfully all of them have insurance. The one who ran into me has the same insurance I do. The biggest thing that the insurance adjuster is focusing on were the lack of lights on the white car. I would have been able to see the car sooner had the flashers been on. It will be at least a week before a clearer picture of what happened comes about, she is going to be contacting the other drivers. It is still unclear who hit who and when between me and the F250. It is pretty clear the white car took the brunt of all hits, it had to have been hit at least 4 times.

Were there ppl in the white car at the time of the accident? You hit the white car, correct?

No one was it it, not sure where they were, but it was empty.

 

Well its all over except the payments. They totaled it today. Was pretty sure they would, but I feel so sad now that my favorite car is no more. Think I will make a cross and plant it by the scene this spring, here is where Darth Vagon met her match. :( Going to be at least 2 weeks before I can get a replacement car though.

It's sad but good for you that they totaled the Darth Vagon R.I.P

Wow, just saw this thread acdii, glad you're OK! I'm amazed when I see how well protected you and your wife were in the Flex, especially when I see the pics of the car you hit! Had anyone been in that car, I don't think they would have a been so lucky. What kind of car was that?

I drove for almost 20 years in winter conditions (NY and Chicago), and while I never liked it, I felt I could handle it. After living in Florida for the past 20 years, I don't think I could get used to driving in winter conditions again. We do get torrential rains sometimes where I can barely see 10 feet in front of the car, and when that happens, I turn my 4-way flashers on and pray that whoever is behind me can see where I am. I also try to stay far enough from the person in front of me so that I have stopping distance if he stops, but close enough that I can still see his taillights so I'll see brake lights.

Again, glad you and your family are all OK!
